Merk
Got a call a few weeks ago: " sir this is jane doe with GMC credit, calling about your account with Chase, since this is more than 3 years old we can't sue you, but we are attempting to collect blah blah blah...." I said , do you have something in writing that you can send me to in order to verify this, and we will go from there? "Sure sir, I will get my supervisor to send that...blah blah...you do remember this debt don't you" I laughed and said..." I won't comment further on this matter until after I see the written document..."Ok sir, we're just trying to blah blah"I said well I know how this works...I'm not the run of the mill consumer...(thanks to basic info from this forum...I felt empowered)She became defensive..."sir, I'm just blah blah...we are sending the letter and I just blah blah, we just blah blah..." and I said...and again, "i will respond in writing when I get the written document" and hung up the phone. Coltfan1972
I'd send the DV certified mail and email. But the law just says notify the collector in writing. So email is in writing. However, you would have some major admissibility issues if this blew. However, they flat out told you that can't sue you. I'm not sure what the big deal is. You obviously know out of statute, they know it's out of statute and they have even confirmed that can't legally sue you. If you're going to send anything, which I would not, why not just a full C&D. Hell they probably won't make it to trial either, base on what I know/see. So I can just send a cease and desist letter. Otherwise, can I do anything to protect my credit report/standing etc. They will just keep reporting or what?
1stStep
If the debt is more than 7.5 years old and it is reported, then you've got an FCRA and FDCPA violation... check your credit to see if they are on there...
Merk
I don't think it's that old
BV80
since this is more than 3 years old we can't sue you,HA! They obviously read the information on the recent case against Asset Acceptance and are protecting their tushies. If the OC is reporting on the CR, the JDB entry can't remain any longer than the OC's entry. Is the OC reporting?

Coltfan1972
All three of them. Not uncommon for them to all be different.
Guest larry666
They say GMC credit services when i call back. I dont have any business with them at all. This is NOT GMAC credit. This is either a scam caller or someone who buys junk debt and tries to collect. I did talk to them but he was very rude when that didnt work he threatened me with physical harm, so i hung up on that fool. He then called back using many 4 letter words. After i said im calling the police he hung up but said " You WILL hear from me or see me soon" , Sounds like a threat to me. Either way i would advise you NOT to talk to these low life scumbags.
