My~Cuz~n~Vinny~ Posted April 4, 2012 Report Posted April 4, 2012 Hi all!I looked online at my case today and found something I am unsure of.Can anyone shed any light on this for me?Plaintiff filed on 03/22/2012 P MOTION FOR EXTENSION OF TIME RE DISCOVERY MOTION OR REQUESTDefendant filed no objection on 03/28/2012 RESULT: Granted 4/3/2012 Looking at the beginning of the case way back when I answered the summons with my appearance *** 2011 APPEARANCE****an item shows up..........04/02/2012. CLAIM/RECLAIM marked as " NEW! ". It is right after the Appearance date of 2011Why is it way up early on in the case instead of following the most recent date?Also...why is there no plaintiff or defendant marked as " Filed by" ?Is this just court procedure? Thanks in advance..
legaleagle Posted April 4, 2012 Report Posted April 4, 2012 When you file a motion, the court has 120 days to make a ruling. Sometimes they do not. The party may then "reclaim" the motion to get it back on the calendar to be ruled on. The reclaim is always posted underneath the item in question. Also, motions have to be marked by the party filing them when they appear on the schedule. Marking means you call the clerk and tell them what you want to do. Take the papers, or ready for argument if it is an arguable motion, or off. (cancel) Sometimes people forget to mark, and no action is taken. You may then reclaim the item immediately. I have no idea why they would reclaim an appearance. Makes no sense. Look to the left of the column, you'll see a D or a P next to the item showing who filed it. You can only reclaim your own stuff. I can't see your case, so i don't know what item is being reclaimed.
My~Cuz~n~Vinny~ Posted April 4, 2012 Author Report Posted April 4, 2012 (edited) Thanks LE !!There is no ..P...or.... D... as to who filed it?There is no comment as to whether it is arguable or not either?I looks out of place. They never did object to anything on their request for admit and combined interrogatories and document requests which they sent on 01/26/ and which I answered by 02/22.I withdrew my Summary judgment as well...however by "that time" they were wanting to revise my Summary judgment request by asking the judge for an extension of time to have me change it They also had several objections to the summary judgment I had motioned the court for.******I am thinking if it is them...they are trying to get back what they wrote in their brief concerning my summary judgment against them. They made two or three admissions in their brief that were untrue ...and I think they would like that to go away. ***** What do ya think? Here was their latest request....MOTION FOR EXTENSION OF TIME RE DISCOVERY MOTION OR REQUESTPursuant to Practice Book § 13-10, plaintiff hereby moves this Court for an extension of time in which to object and/or respond to Defendant's Interrogatories and Requests for Production of Documents dated in the end February , 2012. In support of its Motion for Extension of Time plaintiff states as follows: 1. This is an action for collection of the defendant's credit card balance. 2. This case is not scheduled for trial. WHEREFORE, plaintiff respectfully requests that this Court grant this Motion, and permit plaintiff an additional 60 days, in which to file objections and/or responses to the Defendant's Interrogatories and Requests for Production of Documents.
