FDCPA violations sent from heaven?

Recommended Posts

Today was a good day for me.

First, the State notified me that the JDB who's trying to collect on a dismissed with prejudice account (wifes) is not licensed to operate in Illinois. According to the Collection Agency Act, that is a class B misdemeanor. I'm not sure how to file a police report on that with a straight face, but yes, I will take some more free ammo.

Secondly, I got a call from my dad today. Amazing, since he died over 3 years ago from brain cancer. And the number he called from he hadn't been at for almost 15 years.

Of course, I knew better. Last week my in-laws called, I answered, no one was there. Click. I hung up. OK, weird. The phone rings again...it's NCO! So same thing today. 10 seconds later, caller ID says NCO. I was so upset...I cried (realllllly milking it) on the phone with habib. he denied doing it.

So I knew today that dear old dad wasn't calling to tell me that the Cubs suck, but maybe, just maybe, he was sending me violations from up above.

Thanks dad!

Well on the licensing issue, I just filed a federal lawsuit Monday morning for the same thing.

So obviously I think you have a nice violation.

I am little confused on the phone call. Are you saying the spoofed the caller ID or acted like your dad on prior calls.

I see. Sounds like lawsuit time to me. Nice violations. Probably could not prove the spoofing, if they actually fought you.

However, the great thing about your word against theirs. Yes, you will probably lose that argument, because it will be 50/50 if it turns into a he said, she said. However that means they have to show up in court to make that argument. And that is spending big $$$$$$

Also Coltfan, I have phone records. Both computer and caller ID (photos). Plus the caller ID for my in-laws was a bit different than how it normally shows. A reasonable fact finder could conclude that these calls were placed by NCO. I also asked my in-laws for a copy of their phone bill. A little pre-suit discovery will go a long way when identified as "Exhibits" on a complaint. And for my dad, the death certificate will suffice, I hope.

I don't want to be bothered with the little things. But some of this crap is so out of line they have to be called on it. And in that spirit, I will be calling them on it tomorrow, when I call the law firm.

PM me your case when you get a chance. Sorry, but Coltfan doesnt bring up any matches on pacer.

The quickest response ever from a lawyer. Had a copy of the agreement and retainer in my email when i got home today. no phone call back. no letter. lunch on me folks after this!

NICE !! As much as I enjoy court and going pro-se, I'd even get an attorney on this one. I would want to make it as painful as possible for the other side.

The best way to do that is large atty fees on top of any award settlement. Take em down.

Pass this message to your attorney from me... ::BigGun::
