Found This Sample Validation Letter. Thougts?

Hello:

I'm trying to get my act together and send out a DV letter to a new JDB while I have time. I got the dunning letter about 20 days ago. I found this sample letter online and want to see what you think:

Dear Collector:

This letter is being sent to you in response to a notice sent to me on (insert date letter sent by collector). Be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692(g) that your claim is disputed and validation is requested.

This is NOT a request for "verification" or proof of my mailing address, but a request for VALIDATION made pursuant to the above named title and section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you.

Please provide me with the following: a simple accounting of the debt, the name and address of the original creditor, and the original account number. Also, please show me that you are licensed to collect in my state and provide me with your license numbers and your Registered Agent.

Your anticipated cooperation in this regard is greatly appreciated.

There is a Sample letter #9 on this forum site which is more detailed than yours. I would use the one from the forum.:)++

Well the world is officially coming to an end. I agree 100% with Dr. Evil again. That is two times in the last hour.

Not just the form letter on this site, but all form DV letters do nothing but tip off the other side that the consumer sending the letter has no clue about the law.

Coltfan didn't suggest that. He merely pointed out that the letter requests info that's not required for validation.

All that's required is the name of the OC and the amount. What Dr. Evil suggested for a letter is perfect. All you'd have to add is the account number they gave you.

I won a lawsuit based soley on a collector not sending DV yet continuing to collect. That was the only violation. Always make them prove the very low threshold, just understand how low the threshold really is.
