Ready, Fire, Aim!

Recommended Posts

I can't believe how many threads I see where people come on and say "I was sued, here is what I answered with, how does it look?" Or they ask for guidance, ignore, file something and ask how it looks.

Please have the board critique your motions and filings! ::idea2::

Or sometimes worse is when they post that they need to file an answer by tomorrow!

But if someone claims the eggshell doctrine, that is worth 5 bonus points. I'm still in awe of that one.

I don't think that it would hurt to help those who come late to the party so to speak. I gain alot of insight by helping. Think of the board as an ER, if we help it will help others who may be lurking.

And if you were helped at the last minute by the board like this post.

I'm not saying anything negative about helping people last minute here. I would rather see someone fight and win any day hands down.

(gulp) I would also rather see someone lose trying than lose by default.

But without due diligence on the part of the defendant, it can be difficult to prevail, even against a JDB.

A lawsuit being filed is not the first step in the collection process; it's somewhere very near the bottom.

For example, I first got sued in September. My first letter from an attorney was in July. I didn't wait until October to try to figure out how to pull a rabbit out of the hat--I was well read and had been lurking here for months by the time I appeared at court.

In my case, I've been reading for over a year and I really didn't start posting until recently. The same at another forum.

While I was able to defend myself in court and then go on the offense in Federal and JAMS thanks to the ton of info out there (so much to sort through) I came out with a very big victory. It was a fairly small, simple case in state court that stumped me!

So now that I am asking questions I feel I should share my success and what works even though most of my experience to date has been in Federal and JAMS, not much of that going around here.

Bottom line, I can't say THANK YOU enough. So I'll say it again!

Thank You!

On their cell phone asking for help at 4:15PM on the last day for filing. It would be even better if that same person filed their handwritten answer with the JDB right behind them in line with default in hand and the clerk saying "I'm sorry to say a responsive pleading was just filed in this case"

That would be a good day.

They may not have had the time to get review and approval of the board brefore the deadline.

This leads to the next phase we have to boost the boards standing on google. we can do this by searching google for the posts on here instead of the search function. This will help people find us sooner. I have created a supermarket tear tab page for the board to increase aware ness in the communities most affected by the credit industry. It is here:

http://www.creditinfocenter.com/forums/1148090-post1.html

Put it everywhere library, church, senior centers, supermarket, coffee shops, I even want to leave one in the city hall. Everywhere there is a bulletin board(the old cork kind not electronic) we should have one.

Getting the word out gets the people to come in sooner and the can then have the board review their answers.

Talking solutions here not ranting.
