I SLAM DUNKED MIDLAND FUNDING AND GOT CASE DISMISSED!

Recommended Posts

Hi all,

I just want to say thanks to all the helpful people here in the forum, I was able to beat Midland and get my case dismissed... It took a whole year to get through this process and I came out victorious...

Seadragon and CALaywer have been a great help and pretty much gave me the tools to put my case together... Thank you so much.

The bottom line is DO Not Stop Fighting until you win!

The funniest thing is when I subpeonaed the affiant at the Midland office the supervisor said to my process server "She works out of the MN office, you will never find her for service here" = Game Over!

This forum has everything you need to win your case.

CA Lawyer Thanks

Seadragon Thank you for the pinpoint help when I needed you

CONGRATS!!!

:BigDance:

I read your posts and wondered how things had turned out for you. I'm glad it was a positive outcome. Did you go to trial or did they dismiss right before?

I'm astounded that they would give an affiant address, knowing full well the affiant won't be there. It would be great if all debt collectors behaved that way, and couldn't produce their witnesses. They're banking on defendants not ever sending a subpoena their way.

OHBOY, I hope i will be in your shoes in AUG. I will be going to Court to file a Subpoena on Friday.. If the Subpoena isn't served what would happen next? I am serving it more than 20 days before trial or should I wait til the 20th day?

Oh could u message me with any cases you were going to use to support your defense?

Congrats!

I am really proud of you. As I have said before, you beat them at their own game. With one arm tied behind your back.

Please remember to seek your costs. http://www.courts.ca.gov/documents/mc010.pdf

It is very important to make them pay when you get a good result like this. Even if it is only your filing fees and service fees you will hit them in the only place they care about: the pocketbook.

  • 4 weeks later...

I will forever help here 1 because it is fun, and 2 because I am still fighting my fight. Glad to have helped and yes you can win if you stick to the winning strategies and stay away from some of the strategies that are not working in Ca.

Once again CONGRATULATIONS, I get a vicarius high from news like this.
