Will the court notify me about the calendar?

Recommended Posts

When I submit an MSJ , will the court notify me on the motion, so I then can mark the motion as take papers or ready or mark as off ? How long does the court wait until marking the motion on the court calendar? Should I request a quicker time frame?

They already submitted theirs. It was denied. Plaintiff was a no show.

After reviewing the record and after hearing the defendant's arguments , defendant is raising a genuine issue of material fact.

Plaintiff motion for re-argue and re-open. They got the wrong court house and showed up 1 hour 1/2 late.

Request for oral argument certified court notice sent 1 day after Defendant's Motion to MSJ.

Question 1. Does the Defendant's filing of MSJ take precedence over Plaintiff;s request to re argue?

Question 2. IF.... Plaintiff's motion is denied ...How long before one can motion the calendar to proceed? Must I wait? or Should I wait.

Question 3. IF.... Plaintiff's motion is granted...will it be considered battling MSJ's?

Question 4. IF..the honored justice says.... you guy's wanna step outside and try to confer ?...

Should I say only if the Plaintiff wants to provide a written contract?

Never trust the court clerk to inform you of important events.

I check the docket 2 or 3 times daily. Try to check short calendar listings and

see if any events are scheduled.

How can I mark the motion as take papers or ready or mark as off..?

Don't I need to wait for the court to put it on the calendar?

Is there any way I can ask for a quicker schedule so I can mark the motion?

Okay, CT. You'll get a short calendar notice in the mail. The person who filed the motion has to mark it and inform you of the marking in proper time. MSJ is mandatory oral argument. If they don't mark it, you don't have to go to court. No marking = OFF. If the marking shows up late, and their motion is granted absent objection, (common trick) you have to file a motion to reargue which should be granted no problem as long as you attach your supporting documentation.

If it is your motion, as soon as you get the short calendar notice you have to call in the marking. The notice will tell you when to call. You are also obligated to inform the other side how you marked it. There is no take papers on MSJ. It's oral argument, ready or off.

Okay ! MSJ is only marked off or ready. Thank YoU! Yes. The last time I made motion to a calendar event I sent the Plaintiff notice of the upcoming event and how I had marked it.
