Hi New Here Got Something to Look At

Hi,

I am new and been browsing. Sure is interesting.

A little about me first, I am older, retired on SSDI and about 13,000> up in debt on CC's. I don't own any non-exempt property except a paid for a pickup that is 15 yrs old. Just moved to downsize and ran into lots of unexpected repair's where I am and thus had to use the credit to fix things such as septic system, new well, repair roof, porch,etc. You get the drift.

I have looked at all my option's, tried several place's to get a loan to consolidate, but they all won't due to my low income. I have considered the BK route (will pro se if needed), the just let them try to collect thinking, and the give them H*** route.

Here is approx list (not going to be real specific, eyes are watching)

A local bank CC for ?? 1500.00

Lowe's (GE Bank) ?? 2500,00

Home Depot (GE Bank) ?? 600

Wal Mart (GE Bank) ?? 1600.00

Shell Gas (Citi Bank) ?? 700.00

Conoco Gas (Citi Bank) ?? 1500.00

Care Credit (GE Bank) ?? 600.00

BOA (FIA) ?? 7,000.00

Still paying on big one right now. And a couple of them are just now coming behind. But the minimun's on these accounts with living expenses are pretty close to my total income. Something's goin give and it's not goin be me.

Plus Regular Stuff Car insurance, Copays on Medical, Gas, Utilities etc.

Oh and an AT&T Bill that went to collection not over 60 days old.

I think this bill ( under 60.00) is with a JDB already. Their name is Crapcredit Collections Services out of Mass. (the Crap part mine). I belive I may have a FDCCA violations for shadowing. I will try to post the letter redacted if I can figure out how but I may not have enough post yet. It is interesting that I make my payment to AT&T Payment Center in Boston. But there is NO AT&T payment center there, Payments from Boston go to Atlanta. Is there deception there?

Since you are on SSDI, they cannot touch your income. You also have no assets for them to get to as well. Filing BK would not be necessary as again they can't touch your income. If you are getting phone calls from them, you can send a "cease and desist" letter stating all communications must be made by mail. Paying minimum payments just prolongs the agony.:)++

Do something one way or the other. Either stop paying and dig in for a fight or file BK (I would not file BK based on your post). If you pay the minimum the above poster is correct, you're basically just throwing your money away.

Can't tell you the best decision obviously, but you need to go all in one way and then ride that decision as far as it will take you.

Here is a copy of the dunning. I think I see a deceptive practice with the bottom part.

There is no AT&T payment center in Boston zip code according to AT&T site.

Real Payments go to Atlanta,GA.

A lesser person might interpet that to mean they are paying AT&T and not a JDB

No they are not part of AT&T in house collections. They are what is called a third party collector, a collection agency. AT&T has hired them (probably have a huge contract with them) to collect for them. They are independent of AT&T. The same if you were to get in a car wreck and hire an attorney to sue the other party. The attorney would do all the leg work and you would pay them around 33% of whatever you got and keep the rest.

Except for some very light collections, like a week or so late, AT&T farms out all of their collections to collection agencies. If that does not work then they usually sell them to a junk debt buyer.

If you want to have fun, Google and read AT&T'S arbitration agreement. Then tell AT&T you want to arbitrate this dispute. That arbitration agreement for anything under 5K and not a class action is written so consumer friendly it's not even funny. They pay for everything up front. Heck if they lose they pay your attorney fees times two or 5K or 10K (can't remember) whichever one is greater.

No way they will arbitrate this thing.

a friend had some letters fro credit collection services, they look like the herb tarlick (sp) of dunning letters, saw a number of FDCPA lawsuits that have been filed against them on the letter but none that I saw succeeded.

if anyone knows af a FDCPA suit that succeded I'd love to see it

The BOA debt is the one that seems likliest to give you the most trouble, the smaller debts to me are easier to deal with. I had a number of nder 2k debts that I defaulted on and at least one of the collectors attempting to collect has violated FDCPA on every one that has come after me.

my experience is that HomeDepot will offer a 50% settlement at about 160 days past due and Lowes will sell the account to a JDB fairly quickly after chargeoff, I had about 20k in debt and was going to file BK but after learning from this forum how to deal with it have not had to file. The collection agencies are paying my bills for me with their donations.

That's why I mistook it for a JDB, just sounded fishy.

That's why I'm posting here and listening. I filed BK 12 or 13 yrs ago and didn't want to go through that again. Dang attorney cost almost as much as bills (almost) and I know that's gone out of sight now.

Seems last few years the money grab is on by the banks, attorney's, medical, state's, and fed's. This can't go on forever, I am seeing some pretty serious financial and other things coming up, when insider trading go nut's as it is now they know somethings up and are dumping stocks for T bills. The american middle class can't keep taking this on the chin much longer.

The house of cards is coming down. If it get's too bad our creditor's and JDB's may have more to worry about than us.............unless they get another bailout!!

Yes, I'm thinking that BOA is going to be a real pain. That's probably where the battle will get sticky.
