Brotherskeeper Posted November 2, 2012 Report Posted November 2, 2012 The judge (begrudgingly) denied Midland's motion for summary disposition and rendered judgment in favor of the defendant. Good news is we won our 2nd lawsuit with the borrowing statute/statute of limitations argument, although our 2 cases were not identical and required much additional research. Bad news is it appeared as if the judge would've had little problem with the standard JDB "evidence," which seems common in Michigan. Midland did not tuck its tail and run. They fought harder (and dirtier) than we imagined. It was very stressful, to put it mildly. We went through the case evaluation hearing (Michigan's case mediation with a 3-attorney panel tasked to find a settlement), had the summary judgment hearing a day and a half before the trial was scheduled. This meant we had to prepare 3 briefs! Thank goodness we didn't have to go to trial. The help we got from this forum made these 2 wins possible. After a little R & R, I will post some case law and some strategy considerations that may be of use to other Michigan people. These scavengers can be beat!
Public Enemy Posted November 2, 2012 Report Posted November 2, 2012 Another one bites the dust. CIC > Midland
