Judgement advice???

Recommended Posts

My boyfriend has one other thing hold up his credit recovery status.

JUDGEMENT!

This judgement is for a atv that he started to buy in 2005 he made a few payments, but got into some trouble and ended up going to prison in the middle of 2006, where he served 43 months.

He was never aware that this Judgement existed until he pulled his credit report and found it there. He never received any information on it, nor did anyone else.

The county in which the judgement is in said that it went for being a $2,200 bill to now over $10,000.

We contacted the original debtor Oregon Auto Finance, and got pretty much no where with them. They were rude and unfriendly...

On 11/30/2012 I sent them a Debt Validation letter which I copied and pasted from this site and simply filled in the blanks. I sent it cert mail with a return receipt requested. I got that back today but it was signed 11/31/2012.

So currently we are waiting for them to either reply or not reply so that we can take the next step that it says to take on this site.

As for the judgement how do we go about trying to get that lifted? I sent the letter to the original debtor who is reporting it on his credit report.. Do I wait and see if they respond? Or do i need to send the county something as well?

I would try to look up information on the Judgement on the county in which the Judgement was filed. Some States/Counties post all documents online and others do not. It might be worth a trip to the Clerk of Courts to get a copy of the documents.

What you want to do is Vacate the Judgement. Start searching online for the process of vacating a judgement in your State. Also, search this forum for terms like "Vacate Judgement" and see what others have done.

There's a thread to start:

Are you an attorney. You keep saying you sent this or that. If it's your boyfriend's debt/judgement, then he needs to be doing this.

However, you will get your DV back. It will be a copy of the judgement. That is all that is required under the law as part of DV. Actually they probably don't have to respond, but probably will because they will just say see judgement.

Was he in prison when the law suit was filed? Was he served? Certainly they would have been able to find him. It's not like he could hide, and any law firm should have equal access to court records, it is their responsibility to know where the defendant is. What happened to the ATV? Was it repo'd? There are specific laws that cover repo. Who owns the judgment, the original creditor? The owner would be the one who filed suit. You need to go to the court house and get a copy of the file, we don't have enough information to help.
