Helping someone clean there credit. So Experian is the only one left reporting 2 TL's (One for a loan that never existed.) for Litton Loan. Litton loan no longer exists all assets were purchased by OCWEN. Yet they continue to report Lines as Litton, also the address they list gets letters returned to sender and the phone number says we no longer around call Ocwen. Yet Exp continues to just verify the info. Infact I am getting refusal to dispute/Friv letters. Here is my 3rd letter, Is it to angry? Any suggestions? Anyone point direct statutes, I can't seem to find em to reference.

Re, Social Security Number: XXX

Dear Credit Bureau,

This letter is a formal complaint that there is currently inaccurate information on my credit report. I am requesting a reinvestigation of these items.

Currently you are reporting two negative trade lines for LITTON LOAN SERVICING.

LITTON LOAN SERVICING

ACCT: 1234XXXX

Opened: 8/7/2006

Amount: $29,400

And

LITTON LOAN SERVICING

ACCT: 1234XXXX

Opened: 8/7/2006

Amount: $82,200

Both of these accounts list an address of 4828 LOOP CENTRAL DR, HOUSTON, TX 77081. Litton Loan Servicing no longer exists, Any disputes that have sent to this address have been returned as "return to sender, non deliverable". Furthermore the payment history for the $29,400 account is incorrect, And I have NEVER held a loan for $82,200 from Litton. Much of this information is obviously wrong and the rest is easily provable as incorrect. Yet your you still seem to verifying the disputes for these accounts and now refuse to place a new dispute altogether. Please know you are in direct violation of both State and Federal Law by both knowingly reporting obviously inaccurate, invalid, and/or fraudulent information and refusing to process any further disputes for these items. More Specifically you are in violation of several statutes of the Fair Credit Reporting Act (FCRA).

Sincerely

Your Pain in the Behind

If these Items are not deleted within the next 30 days I will be lodging complaints against you with the Federal Trade Commission, Better Business Bureau, Office of Comptroller of Currency, Consumer Financial Protection Bureau, Missouri Attorney General and Texas Attorney General. Furthermore, I will consider filing suit for damages that I believe your willful non compliance of the law and possibly even fraudulent activity has caused me.

Yeah, yeah, yeah, yeah, straight to the bird cage liner.

Your not going to do anything other than complain and they know it. Sue or get off the pot. Stop with all the I might do this and I'm going to complain to a bunch of people that will just send me a auto reply form letter or email.

You send one letter and then if they don't do what they are legally suppossed to do you sue. If your on your third letter they know you are full of it and are going to do nothing. Expecting them to not even read this whole letter. Sorry, it's just letters like this give those of us that actually follow through a rougher time because they are used to dealing with stuff (nice term) like this.

Sue or get off the pot.

I don't see anger. I see "internet form letter".

Coltfan is right. I had an issue a few years ago where I had a TON of violations by a collector, and ended up killing about 30 trees going back and forth over many months, just to get a deletion.

I should have just filed and been done with it.

For your friend's situation, a simple letter should be sufficient. Three paragraphs at most. ONE PAGE.

You mention "loan never existed"...what do you mean?

Wow, I actually typed that from scratch. Guess it shows. I mean He only ever had one loan with litton. Litton themselves couldn't find any information on the 80K loan when they existed, But wouldn't do anything about it. Not a soul can tell where it came from. To make things worse is it was a mortgage purchased from one company, the purchased again, then again, then Litton, then Ocwen. He filed BK, discharged litton, 6months later OCWEN purchases litton group and bam from 1 to 3 tradelines on 60 seconds, One of which is from a no existent loan.

Anyways, Ill modify to basically eliminate all threats and send it anyways. tomorrow Ill have him call the courthouse to initiate a small claims.

When I was cleaning junk off my CR, I only had to file suite once against TU and frankly even I knew I was on the losing side. 2 days after they were served the Lines disappeared and everything got dropped. Amusingly, After that bunch of other items also got removed both good and bad and nothing has come back. That was little over a year ago.

Its worth a try, anyways. I have never heard of a small claims case for a $1000 going federal. I imagine if it came down to them settling for no money and just the rightful deletion of truly inaccurate info vs escalating and spending money, They would.... Then again this is experian we are talking about.

It happens all the time... several of us have filed FCRA suits in small claims and they are always removed to Federal.

But I think we'll just let you learn the hard way - when your hit for Experian's attorney fees - the cost of defending an FCRA suit in AZ averages $20k. You lose - you pay $20k.
