debtchick2 Posted November 7, 2012 Report Posted November 7, 2012 (edited) Dell Account-Statute of limitationsState-Pennsylvania Charge off-November 2008 Total charge off amount-$2500 Paid towards balance-$1000 via FRS (collection agency) I offered a final payment of $125, to clear the account! FRS sent the account back to Dell’s (in house collections department). I called Dell, and I offered another $125, they “said no” (such a shock). Dell offered $780! One final payment or extended to 90-days, and the payments broken up for 3-months. My question is shouldI take the offer? Or just ride the storm? I know Dell is famous for taking folks to court! My last payment with FRS, just in August-2012? Suggestions? Advice? Edited November 7, 2012 by debtchick2 typo's
WhoCares1000 Posted November 7, 2012 Report Posted November 7, 2012 I would not pay anything at this point and put the money aside. If they sue, offer a settlement with the money you put aside and then be done with it. Otherwise, keep offering. You might want to sweeten the deal a little bit though. I would suggest going at least to $250 and see where they do. All they can do is say no.Otherwise, the SOL does not run out for a long time.
debtchick2 Posted November 7, 2012 Author Report Posted November 7, 2012 The SOL in Pa, is 4-years! Did I extend the SOL on this debt?
WhoCares1000 Posted November 8, 2012 Report Posted November 8, 2012 Paying on a debt restarts the statute of limitations both for lawsuit purposes and for reporting on credit reports. That is why they did not take your offer. You would have been better off to have saved the money and offered is as settlement after the year had gone by than to pay them.
Torden Posted November 8, 2012 Report Posted November 8, 2012 The SOL in Pa, is 4-years! Did I extend the SOL on this debt? The SOL period is figured from when the account went past due or the last payment was received. Or maybe from a month after the last payment was received (an implied past due). So yes, paying keeps extending. The SOL runs from after that.
