Question about Debt Validation

Hey guys, thanks you for any help I may obtain in advance :)

I have read over several debt validation post stating that the collection agency must cease collection activity (remove) items from credit reports if the item cant be validated.

Well I have requested validation...it has NOT been around the initial contact. This debt validation was basically after noticing they were on my credit report and me fighting to get the listing removed.

I was made aware that since it was long past the initial communication, the collection agency is not required to respond to a debt validation request.

But I keep reading everywhere that if they dont respod to my debt validation request, yet a credit bureau verifies any dispute against them, it is a violation....

Is this law only pertaining to the first level of communication? Or does that apply to a validation sent at any time?

Ive read through quite a few threads that list the law that the FDCPA but im confused on wether or not it applies to debts that are within the time frame of 1st communication?

Someone please clear this up for me. Ive requested debt validation and got nothing. The big 3 however come back verified. Not sure what my next step should be.

Again, thanks a lot for any information. I really appreciate it:)

Only if it's within the 30 days of initial contact.

Well there you go.

Correct.

That only applies during the initial 30 days.

hey thanks so much for clearing that up for me.

I guess my question now would be...

can't I dispute that the initial contact was me viewing my credit report...and that I never got a bill, phone call, dunning letter or anything else.

therefore, my initial contact was viewing my credit report and sending a debt validation request

For what you're trying to do, just dispute with the CRA and the creditor. You can file a dispute anytime. They have to respond to a CRA dispute no matter when you file the dispute. It's actually accomplishing the same thing you are wanting to accomplish with your DV. You're just going to go about it another way. Just getting in the back door what won't fit in the front.

right...I gotcha...that's why I disputed with both collection agency and credit bureau...I'm not sure where to go from here though bro. the credit bureau verified my dispute when the collection agency hasn't sent me any sort... I mean nothn.g...

where do I go from here? intent to sue letter to the collection agency and a request to.credit bureau asking how they verified?

I've read a few threads...I guess I'm kinda lost on what order to do things...if anyone has a direct link...I don't mind reading at all...I have used the search button and.I have got a lot of useful information but sometimes its hard to.follow one.thread when there's others that have a different format or way of doing things
