witchywitch Posted November 10, 2012 Report Share Posted November 10, 2012 I need To answer this ASAP.The law office answered my motion to compel arbitration..They want it to be denied.."defendant fails to even allege is that she has filed a complaint with any of the contractually acceptable arbitration forums. Defendant seesk to stay in litigation but yet fails to offer any evidence that a complaint in arbitration has been filed"Unless and until the defendant actually files for arbitration with one of the arbitration forums which is allowable under the cardholder agreement, any application to dismiss or stay the lawsuit must be denied.They also sent me discovery letter..Shall I file the arbitration and submit it to JAMS now?ThanksWhat would be my next step..
