Shurik63
Hi everybody, recently I checked my CR and found out that Protfolio Recovery had purchased debt from BOA that I had with my ex wife. She was the primary holder and I was an authorized user. Should I sent them DV letter or just wait until they file a complaint then answer it and ask for discovery. I do not communicate with my ex any longer, but have a feeling that they reported this debt on her CR also.Thank you all in advance
BV80
They're not required to respond to a DV that's sent because you found their entry on your CR. That's not considered a first communication from them. Also, if this is your wife's account and not yours, you wouldn't be considered a debtor. As long as you're just an authorized user and not responsible for the account, I would dispute the entry with the credit reporting agencies. You can dispute on the basis of being an authorized user. I've done that with a couple of accounts, and they were deleted.

Were you just an AU, or were you a cosigner to the account? If the former, then you have a valid reason to be removed from collections on the account. If the latter...not so much.If they sent you the initial letter and you're still within 30 days, ALWAYS DV! But if you just discovered them on your CR, don't DV them out of the blue.have they sent you anything trying to collect?
Shurik63
Thank you for quick response.I have not received anything from them. I am not sure 100% now that I was a consigner or an AU. So what I understand is if I was a consigner I would not be able to remove this entry from my record and should not sent DV letter either. I should just wait until the sue me?TIA

Your first step right now is to dispute the entry with the CRAs. have these CAs sent you any collection letters yet?
1stStep
Once you dispute with the CRAs, they will probably start contacting you...
Amerikaner83
Once you dispute with the CRAs, they will probably start contacting you...which then gives you the opportunity to send a timely DV letter If they remain on your reports after the CRA dispute, that is. Shurik63
Thank youI am going to try to contact CRA. Is there a legal from to write the letter on? Does anybody have a sample of this type of letter? Should I notaries it? I would greatly appreciate it. Do I send the same letter to all three CRA. I did not check the other two, assumed if one has it all have it. Ty
Amerikaner83
Do NOT assume if it's on one it's on all three. That is not always the case, and in fact it is often not the case.No notary required, just a simple letter with your name and info on top, followed by an "I dispute this account _______ for the following reason(s): _______And that's it. Send it Certified mail, return receipt requested (CMRRR) so you have a paper trail if need be.
