Jena29 Posted November 15, 2012 Report Posted November 15, 2012 So, A month ago I DV'ed Jefferson Capital. I rec'd a response from them two weeks ago, that they were looking into it, and in the meantime would stop collection efforts and delete all reports on the credit bureaus. When I pulled my report a couple days ago, it was still there, but I calendered to check it in 30 days.Today, I received a call from them on MY WORK cell phone~ a number I have never given out to anyone for personal reasons. How did they receive my work cell phone #, and are they allowed to call it?
1stStep Posted November 15, 2012 Report Posted November 15, 2012 They are allowed to until you notify them in writing to stop. Did they provide anything to validate? If not, you have an FDCPA violation.
Jena29 Posted November 15, 2012 Author Report Posted November 15, 2012 They never provided me with anything- only sent me a letter that they would cease collection efforts and remove the entry on my credit reports until they can validate. That was two weeks ago-nothing since.Until this phone call today- on my work cell phone...
1stStep Posted November 15, 2012 Report Posted November 15, 2012 Sue - it seems like it'd be continued collection activity.
BV80 Posted November 15, 2012 Report Posted November 15, 2012 No they are not allowed to call your cell unless they dial manually. If they use a predictive dialer, they must have your permission to call. It appears they didn't have it.When they called your cell, did you answer or did they leave a message?
