Came across lawsuit involving JDB1 (purchased alleged account from OC) and potentially compromised files that were sold to JDB2/Plaintiff in lawsuit against me. (JDB1=UCR purchases accounts and assigns to debt collection companies but retains ownership.)

QUESTON: Can I use this info against Plaintiff at trial or beforehand? And how??

UNITED CREDIT RECOVERY LLC v. BEXTEN (et al.)

Case no. 6:11-cv-1714-Orl-31KRS

United States District Court, Middle District of Florida, Orlando Division

Filed: 10/25/11

UCR filed instant lawsuit and restraining order.

From Order dated 11/04/11 (to dissolve restraining order):

In mid-October, Bexten disabled World Recovery’s access to his software. Apparently, this action had the effect of preventing UCR and its affiliates almost entirely from doing business.1 Bexten also began processing, for his own benefit, debt payments that had been intended for Imperial.

Timeline of relevant dates:

Aug2011: Portfolio Sale Date = OC to UCR (JDB1)

10/25/11: UCR filed the instant suit, along with a motion for a temporary restraining order to restore its ability to collect on its accounts and to bar Bexten from continuing to do so.

Feb2012: Bill of Sale date JDB1 to JDB2 bulk sale of accounts receivables

Thanks in advance for any input.
