caligirl2012 Posted November 26, 2012 Report Posted November 26, 2012 I have an account with walmart that charged off earlier this month. Today a gentlemen from CAC Financial called and left a message on my cell. He asked for me, then when on to say this was a private matter and if I was not the person then don't listen. He then waited a few seconds and went into his spiel that this is a collections call and an attempt to collect a debt.... and then he left a phone number. sighI called him back to see what it was regarding and it is the walmart account. I owe 3200 and he wanted payment in full. I told him that was not possible I would need a payment arrangement. He asked what I could put down today. I said nothing at the moment. He was insisting that I was saying I refused to pay, and I argued that he was putting words in my mouth. I said I couldn't right at this moment, but I wanted to.He then asked me for my hubby cell. I refused to give it to him. He asked where he worked. Again I refused to give out that information. I told him this was my debt and he is not to contact my hubby. He said I dont need your permission because I live in California. Is this correct?Again he said I was refusing to pay and I corrected him and told him that I never said I was refusing to pay. I said I couldn't at this time. At that point he basically was done with me and hung up on me.I have also not recieved any written communication from CAC regarding this matter. So I guess what I would like to know, is have they violated anything and should I expect to be sued. I am on disablity but my hubby does work full time. I am not on his checking account. My disablity goes into another account that is in both our names and that is all that is deposited in that account.Any help or guidance would be greatly appreciated.

1stStep Posted November 26, 2012 Report Posted November 26, 2012 If this his inital communication with you, he now has 5 days to send a dunning letter to you...At this point, no violations that I can see. He is allowed to contact your spouse about the debt. You may want to remove yourself off of any joint accounts as a prudent measure.
Flyingifr Posted November 27, 2012 Report Posted November 27, 2012 Caligirl - California is a Community Property State - debts of one spouse are the debts of both. Not only can he call hubby, he can sue hubby and collect from hubby.
