ANOTHER ONE BITES THE DUST

Recommended Posts

Can't give details except to say 9th FDCPA suit is won. They pushed on my 30days to request validation and we pushed back.

New Years Resolution will be to break double digits:D

To the newbies out there, save those letters, DV the hell out of them, keep good records and take them to town!

Quick question for you, do you need to dv a collection agency every time it changes hands? In other words, if one agency attempts to collect but is unsuccessful then it is given to another collection agency to attempt to collect, must you dv them as well?

I collected some mail from my Moms and found 2 different CA are sending letter to her? I don't know when they started because often she just throws my mail out. I have one suit I'm fighting and one pending (they haven't served me yet). Should I DV them or just leave it alone until I get through my suit of which we are in the thick of it right now. Curious about that process but didn't even want to pursue it because my head is spinning from all the stuff I am learning and have yet to learn! thanks:)

If you are within your 30 days from the first notice send the DV if they are more tha 30 days old they are not obligated to respond to the DV

I have sent a DV past the 30 days when I first started sending letters out and it was about an even split in being ignored, having the debt sent to another collector and getting a response

Well, it is from reciept of their letter

It's 5 bucks, you could always try sending one and saying

"I received your letter demanding payment for an alleged debt to XXX on November 25th 2012. I dispute the debt and request validation.

Please send all correspondence to my current address of PO Box 123 my city."

Merry New Year antiquedave!

Vinny is comfortable about DV'ing now.

Dear occupants of 1313 North South East Street:

Vinny does not know who you are.Vinny found this form letter in which some unnamed occupant, at the fore mentioned address, is suggesting an indebtedness due and owing. This suggested indebtedness is invalid.

Kind regards

Vinny

P.O.Box 267

Podunk alley,Washington D.C.

EDIT:

Most assuredly the blokes at the debt collector/attorney firm will send an alleged account as stated.Again with another little form letter stating:

Here is the verification you requested. Please contact us to resolve this issue

Hold the flipp~n~phone man. Vinny ain't asked for no such verification! Vinny realizes this contact is not a legal violation. However Now Vinny sends and notarizes a response letter to this newest contact.

That's it I don't know if it is 30 days as I do not know if I have had mail that was thrown out. Does that make sense. I sometimes don't collect my mail there and it gets lost or tossed. I get all my important mail at my box!

The law is quite clear on this. It is 30 days from the time you receive the first notice. I always put a line in my DV letters that clearly states "I am in receipt of your letter of xx/xx/xxxx which I received on xx/xx/xxxx and is the first communication I have received from you". Then you have documented at the time of occurrence what the events are and put them on notice of the 30 day period.
