I am being sued by CACH, LLC in Los Angeles.

CACH is about to get their witness at tiral.

The witness they are going to bring are Magic West, Christie Coston, or Victoria Mason.

 

anyone know about these 3 people? any case related to them?

 

I am trying to find some cases that related to these 3 people. I might be able to use it to attack them(I think).

 

(I found one case related to Magic West, the case is "Rchard G. ORTEGA v. CACH LLC").

 

I really appreciated if you can find some.

They never show,thats just the scare factor.Is she within 150 miles of the Court where she can be served,is she going to testify about the OC's records,I dont think so.If this is a big money case mabey one could show,if its not its another no show.They hope you dont show.

If you have an affidavit I would subpoena the person who signed it. 

 

First I would answer these questions. It will be easier for others to help you. Just leave out personal information or exact numbers.

 

 

Racecars 20 questions for California

1. Who is the named plaintiff in the suit?

2. What is the name of the law firm handling the suit? (should be listed at the top of the complaint.)

3. How much are you being sued for?

4. Who is the original creditor? (if not the Plaintiff)

5. How do you know you are being sued? (You were served, right?)

6. How were you served? (Mail, In person, Notice on door)

7. Was the service legal as required by your state?

8. What was your correspondence (if any) with the people suing you before you think you were being sued?

9. What state and county do you live in?

10. When is the last time you paid on this account? (looking to establish if you are outside of the statute of limitations)

11. What is the SOL on the debt?

12. What is the status of your case? Suit served? Motions filed? You can find this by a calling the court or looking it up online (many states have this information posted - when you find the online court site, search by case number or your name).

13. Have you disputed the debt with the credit bureaus (both the original creditor and the collection agency?

14. Did you request debt validation before the suit was filed? Note: if you haven't sent a debt validation request, don't bother doing this now - it's too late.

15. How long do you have to respond to the suit? (This should be in your paperwork). If you don't respond to the lawsuit notice you will lose automatically. In 99% of the cases, they will require you to answer the summons, and each point they are claiming.

16.We need to know what the "charges" are. Please post what they are claiming. Common counts, account stated,breach of contract,for money received on behalf of the plaintiff, open book account,unjust enrichment.

17.Is the complaint "verified".? A verified complaint is one in which the last page it has a declaration from someone stating that the information and allegations are true and correct under penalty of perjury.

18.Did you receive discovery or interrogatory or Admissions (questionnaire) regarding the lawsuit?

19. What evidence did they send with the summons? An affidavit? Statements from the OC? Contract? List anything else they attached as exhibits.

Yes, apparently that is a real person.  I have seen him/her mentioned as a CACH witness in other posts and forums.

 

And, some people also commented, is that a porn star?

Sorry that I skipped all info.

 

1. I don't know he/she is within150 miles of the Court.  They didn't say. Court is located in downtown LA.

2. money is 9500 total

3. testify about the OC's records? i don't think so.

I am currently being sued by a lawyer for CACH LLC (Sears/Citibank card) in Ohio.  I was also given the names of those same three people who "might" show up.  I have to agree with everyone else and say that it's a crock.  I highly doubt they travel all over the country from California to Ohio to wherever.  They're prob bluffing.

Magic West, Christie Coston, Victoria Mason, and Jay Mills are allegedly authorized agents of CACH, LLC c/o Federated Law.  Magic West on his LinkedIn Profile is listed as Records Custodian at Square Two Financial in Denver.  Current employer is Collect America, SquareTwo Financial.  His experience is Trial Testimony Specialist.  He is listed as a potential witness, but surprisingly not as an expert witness.  I'm still trying to find out about the others.  They probably are all trial testimony/'records custodian' specialist types.  If they do try to testify, chances are they will make a motion to appear telephonically as it is too cost prohibitive to travel all over the country.  I would object to them appearing telephonically.

As often as JDB's don't bring a witness, sometimes they do. Midland brought a witness to my trial, and the judge allowed the witness to authenticate OC's records. So do not go into this assuming they won't bring anyone, that could be an avoidable, and fatal mistake. Prepare to cross examine the witness, have a detailed list of questions to ask. Think about what you need to disprove, or what you need the witness to say to help you.

 

If the witnesses are listed as witnesses to be called, and not a CCP98 declaration, it doesn't matter how far or close their listed address is. Also some judges don't care about the witnesses knowledge of Original Creditor's business practices. Think how to disprove personal knowledge of the account period.

 

I know most will tell you that JDB's never bring witnesses, and it's a scare tactic, and to not sweat it. But sometimes they do, and you would be a fool to not prepare as though a witness will be present. Otherwise you may waltz into a buzzsaw. These people are professional witnesses (liars). They know what judges want to hear. Prepare to go after the witness hard. I posted my cross exam transcript in my appeal thread, if you would like some kind of starting point for cross exam. However, I made the error of focusing my cross on the witnesses lack of OC knowledge. Sometimes judge doesn't care.If you want to win, I would walk in loaded for bear.

That is why I subpoena the person that actually signs the documents. Most JDBs hire low level employees and hang carrots in front of them to "process" and "sign" as many "documents" as possible. This does carry some risk if they show up and you lose, because you might have to pay for travel expenses. I still think its worth the gamble because I doubt they want to have any of these employees in a courtroom.

I have heard of Magic West actually showing up to testify at  a few trials. I have subpoenaed Jay Mills, but they dropped the case instead.

@CRDTNogood This thread was revived from a year ago by another member and as the OP never returned to describe the outcome, it's highly unlikely you'll receive a response from him. Too bad too, I dislike not knowing how members faired.
