Sk8gr8 Posted February 28, 2013 Report Share Posted February 28, 2013 I received a letter from a collection agency/law firm in Massachusetts the other day saying that they are going to file a lawsuit (and they name my district court) if I don't respond "promptly" to make a payment arrangement and provide them with all of my financial information. The debt is a Bank of America cc debt that was 11k. I stopped paying in Jan. 2012 because I could no longer afford the payments. I have received letters from this firm but no phone messages (lots of hang up calls though). I do own my home (protected under MA Homestead Act) and I'm on SS disability. I have no other assets. I called Bank of America yesterday and the account manager told me BOA does not have the acct. anymore and that a CA had it(different from the one I've been receiving letters from). I asked her if she knew anything about them and she told me that they probably work for the first CA/law firm. The CA/law firm is Lustig,Glaser,Wilson,PC. and it is for the acct. XXXX with FIA services. I have not called them at all. Should I write and DV them? I haven't been served with a summons yet. Link to comment Share on other sites More sharing options...

There are so many more posters in this website that are more knowledgeable than I, but I have learned a few things. 1st in my opinion you probably have the firm in violation of 2 statutes of the FDCPA. Someone will surely answer those questions. 2nd make sure you save the letter and envelope that it came in to establish the actual dates of the letter. 3rd you have 30 days from the date of the letter to respond. MAKE SURE YOU DO! 4th never sign anything that you send back to them. They have your name/address and collection account # so that's all they need.5th NEVER! NEVER! send them anything personal i.e. SS #, bank information, tax information. My guess is you need to compose a C&D first, then before the 30 days are up I would send a simple DV. Just requesting validation (all the other items you may request are probably going to be ignored anyway. MAKE SURE YOU SEND THEM CMRRR (Certified Mail, Return, Receipt, Reqested) both on the C&D and DV. Good Luck Link to comment Share on other sites More sharing options...
