gwheelock915
I'm thinking the Bill of Rights is a great way to trigger some consumer fraud type actions. http://www.midlandcreditonline.com/cobr/Consumer-Bill-of-Rights.pdf Interesting that the Bill of Rights does not actually cover proving ownership of the account. That might be too hard.
BV80
I don't believe we'd have any grounds for an action based upon their so-called "bill of rights". It's just a bunch of bull they came up with to make themselves look "nice". It's not an actual policy that would provide for a private right of action. gwheelock915
The Bill of Rights is just the vehicle for the litigation. I agree that there is no cause of action based on that alone, but if Midland wants someone medical records, for example. then that might. I wouldnt trust them for anything. Go to their website and click on the green bubble that says feedback. It will ask you to enter your 10 digit account number that starts with 85 (make up any generic 8 number combo) and see what kind of information they want. They are literally on a fishing expedition to see who has what available to them. Scary, actually.
