Being harrassed by phone on debt that's over 7 years

Pinnacle credit services has re-aged my debt 3 years and is harassing me by phone. It's been so long since I've fought any collection agencies, that I've forgotten everything! Can I turn them into the Sate Attorney or something? How do I prove they have re-aged my debt 3 years and what do I do next? I don't even know if they own this debit anymore.

@Been_Ponzied - it's all tied to the original debt.  Are you sure they reaged it?  If the OC is off of your report and they are reporting, I would say for sure that it has been reaged, but you may need good documentation.  What do you have?

All I have are my credit reports that say 2010 as date of first default (when it was actually 2007). I disputed them and it came back the same. Do I try with the CRAs again, or start writing letters to the debt collector? Isn't it just my word against theirs? The CRA's do not seem to do very well when disputing the date of first default!

No way, I was homeless for 9 months and moved a gazillion times. I am judgement proof.

There is no such thing as "judgment proof." What you might be right now is collection proof. Not having a job or assets at the moment only means they cannot collect NOW on a judgment. In some states judments are good for 20 years and are renewable enabling them to sit and wait until your financial picture changew.

They have probably already flagged your credit reports and at some point when you stabilize and try and clean it up they move to collect.

Now they are sending me letters. And my financial situation is NOT going to change. I'm old, retired on SSI. I don't own a house or anything. Anything in my checking account is and always will be from Social Security. Gee, I didn't get any help over posting this question at all.

Send them the letter known by many names:  "cease communication", "cease and desist", "refuse to pay".  Just saying those words alone, sent via CMRRR, should shut them up.  If not, take the returned green card showing when they signed for the letter to an attorney.  That leaves a chance they might sue, which would be pointless for them as it will cost them money (you make sure it costs them money by answering the complaint and showing up for court) for no chance of getting anything.

 

Providing ALL information up front would get the good answers sooner.

You can always turn them over to your state attorney general, @Been_Ponzied. But you need some kind of proof - if you were homeless, do you have any records?

Being on ssi makes your money "judgment proof" they can not garnish it., you are correct there. If you have anything that can prove the debt has been reaged you have a good case against them.

Clydesmom is technically correct - being uncollectable does not mean they CANNOT sue you or get a Judgment. It just means that for now they can use that Judgment as toilet paper.

 

Now... I am in a slightly different position. My income cannot be attached for debt because it is 100% exempt - pensions and Workers Compensation by State law, Social Security be Federal law. I own no assets (no car, no house. Am I judgment proof? No, but it will be a LOT of fun seeing a lawyer try to collect from me if I don't want to pay him anything.....

Oh this is funny. Any records that I was homeless? When all you can think of is where to park your car that night so the cops can't harass you (and they almost always wake you up and do), the last thing on your mind is getting records! Apparently you don't believe me. I am on SSI and therefore my checking account, which has ten cents in it, is exempt. For them to try to sue me would be stupid and I told them that. Oh, and I had to sleep SITTING UP at the wheel because my car was so small. I had to keep waking up to start the car and run the heater. In the snow. Oh and I am stuck with complications from diabetes because I couldn't afford the $2 a day in ice to keep my insulin cold. 

 

For being a  moderator, this stupid question takes the cake. Its because you can't even imagine getting down that far. I had to do this for nine months to save up a security deposit to get into a roommate situation. I had to crap in an open field once. You don't have a CLUE  .BTW, I'm a female in my 50s.

 

I think I can find my own answers from now on rather than ask some rich bitch my questions here. I just need to brush up.

What an attitude!!!  I think Admin was simply asking if you were able to save any records from the past, especially after having been homeless. I think you need to rethink your position and apologize to the Admin for the comment. She was only trying to help.

You'd have an "attitude" too if you had been what I have been through and someone asked you if you had any records through all of that. I'm not apologizing to anyone. No one was there to help me when I was that far down and I reserve my right to have an "attitude" about it.

But.... you are here asking help and advice. Striking out at those who are trying to help reminds me of an old story I heard: 

 

Once there was a beggar on the street corner. A rich man came by and dropped a dime in his cup. The beggar looks at the time and looks at the rich man and takes the dime out of his cup. He gives it back to the rich man saying "if that's all you can give, you need this more than I do."

 

Life has dealt you some lemons. Learn to toughen up your skin a bit more. Not everyone has been in your position and understands it.
