mopman64
Hi all, Wife has Cap 1 acct in collections. Received a letter from CA in our state a few days ago. So I sent a DV with arb request (even though Cap 1 does not have arb anymore). Today I receive an envelope with about a year of statements in it, that's all just statements. I would like to have some fun with this CA. So what can I do to make then do a little more work? I know we owe this and I hate doing this with my bills but at this time in my life I have no choice. Thanks all.
Guest usctrojanalum
You can send them a cease and desist or just ignore them. At this point there is nothing more they are obligated to do.
admin
@mopman64 - they have met their debt validation requirements. @usctrojanalum is right. Nothing more to be done but a C&D letter.
mopman64
OK, I had that feeling. Thanks
Credator
@mopman64 - I like to check if the CA is required to be licensed in my state and whether they have failed in that regard. If that is the case I take the opportunity to inform them I cannot find their license information. I suppose some would consider that "having some fun" with a CA. CAs seem to believe they are on a righteous mission and will often provide more information than the bare necessities/obligations of their debt validation requirements. I don't send a long list of template questions and instead focus on the content of their dunning letter(s) and what I want to know. I have had answers provided to me beyond the bare essential requirements by merely asking. YMMV Some alleged debtors are afraid to poke or engage a CA for various reasons. FAIK I cannot cause or prevent a lawsuit filing against me so I don't worry about poking a CA. As for poking a CA on behalf of a spouse I would probably have a conversation with them prior to such poking. Everyone needs to find their own comfort level and conduct themselves accordingly. Torden
If fun with the CA is what you want: "Dear Scumbag & Scumbag: I noticed you sent me copies of some billing statements the other day. Are you still trying to do that debt collector thing? Because you are not very good at it. If you are wanting some money, I could let you in on this deal I'm working on with an newly found uncle of mine in Benin City in Nigeria. He just needs to get some paperwork processed so he can bring the family gold to the USA. But I don't have enough money for him to do it all, so maybe you can help. I could give you 1/3 of my 20% of the gold."
