Requesting a Delete Letter

Hello to all:

 

I let numerous medical bills go to collections when I was ill. Now, 2 years later I am picking up the pieces. A few CA's helped me and said they would delete the account and let me pay a reduced rate, BUT one CA has been a hassle for a month. Just like the others, I did the following:

 

1) asked for a letter stating they would delete the account once I paid

2) negotiated what I would pay

3) paid the amount

4) received receipts (still awaiting deletion from CR)

 

The current CA will not give me a preliminary letter... They want me to pay first at 80% and then they said I will receive a copy of the hard letter sent to the CR Bureau.

 

Any advice? These guys are the only ones playing hard ball and its driving me nuts. Why cant they be nice like the other fellows?

Would it be prudent to trust the CA when they say "we'll give you a delete letter once you pay"?

 

The CA keeps mentioning the phone conversation is being recorded and that is good enough, no prelim letter is needed... and that he's an excellent person that can be trusted.

This CA, unlike the other 2 will not offer me a letter stating they will delete the account when I pay... So what should my next move be? I called the hospital and I can remove a few accounts with them- thank you for the sound advice, but that leaves a 6 left over. Do I have any cards left in my hand... Or should I hope for the best and pay?

I was thinking about recording my next conversation with the CA... So I have something...

Is it urgent to get these off of your credit report right now?  Time could be your friend. 

 

If not, what do they have on you?  Did you DV them?  If you feel they don't have anything, your next step could be to sue them (reporting without any actual proof).

Admin, 

 

Thank you for the great advice. I did DV them and the debts are legit. I do not need a loan or forsee me needing anything within 3 years. 

 

I still have a few questions: 

(1) If I cannot get a garuntee of delete letter, what should I try for next?

(2) If time is my friend, how long should I wait?

 

I just do not understand why the CA wont give me a Guarantee letter. I want to settle these accounts and move on with my life.

If time is your friend you wait it out.  You find what the SOL in your state is, and when it passes, you send them another letter telling them "The SOL is passed, you have no legal recourse against me to get these debts paid, the ONLY way you're getting money from me is to delete your tradeline. Good day"

 

That's IT.  None of this "please, sir, may I have some more?" type negotiations at that point.  You don't NEED this TL gone, you WANT this TL gone, and the CA knows it! 

 

How long is Florida SOL...4 years or 6?  you're only 2 years old on these debts right now...

 

 

And rereading your original post, I think you're of the opinion that a CA should be nice.  That ain't their job. Their job is to get as much money from you as they can. Not to be nice and make you feel good.  You said that you want to settle and be done...they don't give a rat's behind about that...but they know YOU do so they're playing hardball.

 

 

Oh, and for the love of God, stop talking to them on the phone!

AMerikaner83, thank you sooo much! I called and bothered the hospital, told them why I didnt pay... I told them that I wanted a delete letter and that I would pay in full. After 20 min of being on hold, the boss at the hosptial gave the okay and the changes will be coming down the pipe soon!

 

Should I call back the CA and tell them my success story?

Good job!

 

 

No need to rub the CAs face in it.  They'll know when the hospital tells the CA why theyr'e pulling it back, don't you worry.
