Frustrated with CU
What do I do? Equifax completed their investigation within 2 weeks and removed the account that I did not sign for. TransUnion verified the account but I do not now by what method and have a second letter out to them to ask for details. Creditor will not validate the debt without charging me a fee to do this. Suggestions?
cjtx
Looks like you know what you need to do. Wait for a response for MOV. Banks and CUs get a lot of leeway in the ways they charge fees for their services, so I would send the payment for them to do their research but demand that they refund it because there is nothing to verify it given that the account is not yours. admin
After that, do a 623.
Frustrated with CU
The MOV response was that TransUnion verfified with creditor and it was verifed as accurate. No response to my request for those verification details.

BTO429
They can not charge a fee in order to comply with the law. The law says they must comply, it does not say they can deny your rights if you do not pay a fee. This sounds like an fdcpa, and an fcra issue to me. File suit and let the court decide.
Frustrated with CU
I have done the 623 with no response from the lender. I have also mailed in payment to receive a copy of the loan signature page as they requested with no response or cashing of my check. What laws pertain to creditors being required to supply the requested documentation can I cite in my next letter?

However, the FCRA states they must be reporting accurately if they are reporting at all. If you suspect that they do not have documentation to support their reporting, you can force them in court to supply documentation to back up their reporting or remove the account. It sucks that you might have to go all the way to court, but that's the way you might have to go.
