jono
In view of californias recent lawsuit against jpmorgan/chase regarding shoddy and dubious dealings on old credit card debts , does anyone know if this could be used in anyway to defend a wamu/chase lawsuit . The Ca attorney states that up to a hundred thousand accounts could have been affected by what the lawsuit claims to be unlawful practices ,and I think mine could be one of them .Because of this could not any info the plaintiff may have, be looked at as potentialy flawed. WhoCares1000
The best one can do would be to file for a stay of the case pending the outcome of the California State case. You would need to be able to prove that the outcome of the case could have enough of an effect on your own case that to decide you case now would not be in the interest of justice. 1stStep
Exactly... most likely, expect the other side to object claiming the litigatio will not have any bearing on your case.
jono
Thanks for the reply, The management conference is not until the middle of July and last week I sent them a B O P so I think I shall just wait and see what will happen . I have also sent a validation letter to chase to see what they come up with.
Seadragon
contact the ag and see if the alleged account is involved then maybe the ag can add your plaintiff to the lawsuit.
jono
Yes I will ,As I said before this entire thing is a bit dubios . Just for starters the lawsuit states the default date is a year later than the chase credit report file. Obviously one of them is wrong if chase has it wrong then you would think whoever bought the debt would have it wrong . If the credit collector has it wrong you have to wonder where he got that info from .Anyway we shall see if chase replies to my request for validation.
