They received the letter May 20 so i know they still have some time to respond. If they do not respond within 30-25 days what would my options or next step be? Try to settle with them acknowledging that they did not validate.Send them another letter with the attachments of previous letter and Mail Receipt and ask to remove listing since they are in violation of FDCPA. I just want to be ready, i dont want to let this cool off. Also keep in mind im trying to clean my CR so settling is an option for me and if i need to pay to clean my credit so be it. It is you who had to respond within 30 day, by sending the DV, which you did. As long as they do not contact you again untill they do respond, they are within their rights.If you sent a cease communications, they can only contact you for the validation, or after the validation to tell you what they plan on doing, either they will say we will not be contacting you further, or they will tell you they are sending it to legal. They would have to agree to delete it. If they don't agree, the entry would reflect that the account has been settled. As long as they don't respond they can't (legally at least) continue collection activities. ycastane Posted June 12, 2013 Author Report Share Posted June 12, 2013 The whole idea behind me wanting to settle is just to fix my credit, obviously im going to try to pay for delete option which i know is rare based on this forum or at least reflect a paid. Is it a bad thing if they dont delete but it shows PAID. Ive read everything here on settling and one of the things is says is that a paid is not the best option but is a good option after pay for delete fails. You can probably do a bit better than what the letter offers.
