Midland funding pre trial next week no notification of date

Recommended Posts

At a loss thought I would be prepared. Cruised court site found pretrial set .. First I have heard of it

Midland suing account stated .

Texas. They sent me a redacted bill of sale. Blocked out all pertinent info which would identify clearly the account as mine. Also sent a ribosigned affidavit (known robosigner)

Attesting to the accounting of the account .

Attached credit bills , however none with a signature nor a contract signed by me

Cannot give me a full account of the accounting, including that all calculations of interest and fees were correct. What do I need to do to be prepared for pretrial?

Not sure how they do things in Texas as I am in Michigan but had a pretrial with Midland it wasn't really a big deal (and I was nervous) but the Attorney approached me wanted to talk I said no then we went in front of the Judge who then asked a few questions and set Discovery (more detailed in my post) but that was about it.

Hope this helps :)

Thank you , it does ..I have been told that there is a pre trial(mediation) and then an hour later there is a trial... Is that just opening discovery ? If so, do I need to submit a motion for discovery at that time

It looks like the actual trial. Have they sent you anything? Looks like they are railroading you. you should prepare for objections to their evidence, and to exclude anything not previously disclosed. You need to get up to speed on trial defense.

they are not doing right and I would make sure you moosh them at trial.

I do not believe it is right either. I was told that the notification for pre trial was mailed in late June.original filing feb?? Took this long to get back to me? I have another post with same title that gives the discovery I asked for with my answer, and the answers they sent me . Any insight would be helpful.
