From pro se to lawyer

Hi,

I have been following this forum for quite a while and have been the beneficiary of the kindness of all of the posters here with wonderful advice. I have been sued by a jdb and I learned from this forum how to defend myself pro se. After months of being served and serving the plaintiff with discovery, I was recently served with a motion for summary judgement.

At this point I need some serious help and I'm considering to hire an attorney to vindicate myself. I simply dont have the time to learn this completely new language and culture. Have any of you started off pro se and then hired an attorney to finish off the work? Is that even possible? Any suggestions of an attorney who could help me?

Any and all advice is greatly appreciated!

Some people choose to go that route and usually when they do the JDB will tuck tail and run. They know they don't have the needed evidence to win these cases.

Be careful who you hire. Some lawyers will try to get you to just settle and tell you you have no case. They don't want to do the work on a case they think is below them.

Yes, definitely be aware. Some just want to get business in the door. I was contacted by a couple attorneys after my suit was filed. One of the firms specializes in bankruptcies - no thanks, just from their mailers I got the feeling they were interested in people in distress, not in helping people in distress.

If you look around carefully, there are some lawyers that will help the DIY defendants and help you by "piece mealing" the documents/services that you need.  For example, they can charge you for only filing an Answer, answering discovery, preparing discovery to propound to the plaintiff, and even prepare you for trial or represent you themselves.  This way you only get the help in the areas that you really feel you need the most help with otherwise you learn through this forum as most, if not all, those answers can be found here.

I did not want to pay an atty or the JDB for I debt I did not owe and went all the way to trial.

It is alot of work but to win a MSJ you have to only prove one genuine disputed issue of material fact.

 

I got mine overturned using (in part) "Summary Judgement should not be granted where there is a genuine issue of material fact or even the slightest doubt as to the facts. Farmers Ins. Co of Arizona v. Vagnozzi, 675 P. 2d 703 Az Supreme Ct 1983.

 

You can find an use similar state law for your state. Combingwy is on this site frequently and you could PM him for help.

Thank you very much for all of your suggestions. Anyone on this forum from Wyoming that has used an attorney for defending against a jdb that they were happy with? Please post or message me how they helped you and how I can reach them. Thanks so much!

There are already lawyers on this site to give you help and learning your own rules of procedure and rules of evidence will help you. But first if you want help go the the pinned section and the last one is questions you answer so we can help you.

 

Most people from the year my case went on are self representing and alot of times you can get this dismissed before even going to trial.

Also most courts have online forms so if you live far from court you can submit through e-mail

If you are near to a college with a law library you can ask if there are pre law students that would help with a civil case for a nominal fee.  I've even seen in the barter section of craigslist lawyers willing to HELP with your case for trade. However since my husband is from Wyoming I know your resources are limited up there.
