saytar Posted August 25, 2013 Report Share Posted August 25, 2013 Back again....Got a question. Normally FIA Card services collects for BA, buuuuttt haven't received anything from them. Just a dun from Professional Recovery Services stating their client is FIA. Account shows charged off. Does anyone know if FIA has quit collecting for BA and is now just selling these accounts in the JDB market. They are being very persistent in calling and am going to ...depending on whether they are JDB or FIA a debt denial and/or cease all but mail contact letter. My guess is that FIA still has the account based on past performance, so probably just a cease phone contact letter, thinking of disputing it, but need to know if anything has changed in their methods. The history is pretty convoluted, but they used to be MBNA until MBNA was sort of aquired by BofA back in 2005-2006. I think FIA just handles the processin of BofA CC accounts. I've had the account since the late 90's, I doubt they can come up with any real "proof" other that the standard billing and wishie washie affidavit's. The reason I ask was they said their client was FIA, B/A shows the account written off. So I'm sending a DV with a validation/legal proof of status of debt required, sort of a slight twist to the regular, I dispute, validate, no phone calls letter............short and sweet. Best I can tell they are a JDB, they do do collections, but I don't remember any post that show FIA "selling" accounts as they usually "collect" themselves. Send prc a dv and specifically ask if they own it or if they are collecting on behalf of a client. Ask exactly who the client is, they have to tell you. As far as a cease or for mail contact only, courts have upheld that a cease order is not limited its either cease and desist or not. You can inform them that you revoke their consent to call your phones this would hopefully force them to contact you by mail. Professional Recovery Services is a collection agency; I don't see anything that indicates they are a debt buyer. A cease & desist to PRS will probably see them return the account to FIA, who will likely send it to the next CA on their list. Although I haven't seen an anouncement from BOA that they have stopped or scaled back their debt sales like Chase and Wells Fargo have, it seems likely to me that all of the big card issuers are probably doing this, at least until they can get a better feel for what the new regulations are going to be like. I did modify my letter to specify that that indicate whether they "owned" the acct or if they were just "collecting".........along with a "all calls are inconvenient at anytime". Time will tell.
