Now Mrs. Seadragon has a small problem with her bank sending out electronic payments that where stopped. The bank charged an overdraft for each payment, then charged an NSF fee and clawed back the payed amount. Now they are dunning her even though she has called every 3 days for a month NO ONE will give a physical address for the billing dispute. They are threatening to go after "other" accounts which the only one is the mortgage account. Question #1 Can anyone post the mailing address for any account billing dispute?Question #2 Can they mess with a mortgage loan servicing account.Question #3 Are their Violations of fair credit billing act.Question #4 Has anybody else had Skank of America restart electronic payments for overdraft generation. They had also bought out an old bank that I had a default on, so they now claimed the debt and wanted it paid. My way around it was to refinance it to another bank and get it out of their hands. I do not have Scank of America, but my bank told me when I stop eletronic automatic payments through them, it is only good for 3 months. I must then renew it. ( every 3 months). They said the only wy to stop them permanently was to stop them with the vendor.That sucks because my dispute was with a vendor that I signed a year contract with, received items monthly for 8 months, then changed how I paid them because the card I paid them with expired. When that happened, they started my year over again. I wanted to quit the monthly club, and they wouldn't let me. So I had to go in every 3 months and put a new stop payment in. Seadragon Posted September 1, 2013 Author Report Share Posted September 1, 2013 This was for payments setup by us. When we stopped payments from SoA we started others from the other bank. So the payees weren't prompting SoA for payment. SoA sent the payments after the elec payment was stopped by us and now they will not give a physical address for a billing dispute. You see we busted them for trying to help the mortgage loan servicer to attempt to default us by overdrafting the account by holding some purchases back for over 30 days then dropping them in when the account went low days before the mortgage payment money was transferred into the account. We stopped them cold by disputing the default even though the lady on the phone said it is nothing forget about it. So now we had shifted all payments to another bank and stopped payments out of the account. we held money there to cover any payments for purchases that accidently found their way into the mess. Since they had none they made a payment based on the old electronic payment. This is clearly something they are doing not negligently but intentionally. All opinions are welcomed.#3 - I doubt there would be a violation of the FCBA due to them probably not qualifying as a "creditor" based on electronic payments. An ignored written dispute may fall under something like a violation of good faith and fair dealing. We will send the dispute letter tomorrow and then research a lawyer just in case. You see we were smart and open a few accounts with other institutions when the overdrafts started. now we are banking with several banks that means less is more. I would have more than one bank if I were anyone because when you spread your money out and do business with all the banks then you minimize any one banks actions on you. never put your eggs in one basket, buy powdered eggs. I would make detailed complaints, or a memo to go with the complaint with dates, times, and especially names of persons who refused an address. I would file a complaint with the CFPB, they do actually seem to follow up. Also the state AG or consumer agency. Write Brian Moynihan, CEO at the Charlotte HQ. Sammyvill Posted July 16, 2014 Report Share Posted July 16, 2014 @Seadragon I work for a bank and I see stuff like this all the time, 1st are they using your checking account number and routing number to debit the funds from your account or are they using the ATM/Debit card? If it’s the card then go in close the card and get a new one and they won’t be have access to your account. If they are using the checking account then you can just close it and open a new one that should stop whoever it is from accessing your account. You can also “opt-out” of overdraft payments, meaning that if there is no money they return the item and they should not be charging you for it everything gets rejected atomically. Chexsystmes can be a pain if they report it under “suspected fraud” or “Fraud” and this is what I see a lot from A$$ of America. If they do then the some other banks may want to close you out to. I made sure I had more than one bank account when I open a bank account it is best to a backup just in case the bank fails.They only issue with this now is that bank via checcsystem can see how many inquires one has in the past 6 month can they know how many accounts you have already and will limit you from opening a new account. Best move is to open a account clsoer to the end of the month where a banker has a checking account goal to meet and that way they really dont care.
