kutuzov Posted September 5, 2013 Report Share Posted September 5, 2013 Hi All: A bit off the normal JDB case, I google it for info etc. and here's the story and my thoughts: Been working 7 years with same employer, average hours 35-38 or so depending on the year, for the past 2 weeks they cut my hours to 20 with no previous advice or nothing, they just cut them. I figure a few weeks would be ok I could do my ebay thing paint more and just get over with for those 2 weeks, it worked out and sold a lot (more than I make at work), but my employer got me on the next 2 weeks with 20 hours. I talk with 1 supervisor told me to get with another one and so on until the last one told me to get the first one I got with, so basically they pass the ball and no one answers. So I applied for unemployment. I did that Monday still the application is pending, I'll work into that tomorrow. Anyways I talk with my supervisor again and told him I need to change my availability, since they only give me 20 hrs I need to look for a second job and can't afford to have open availability since I got to plan on what hours I'll be off, that didn't went anywhere they just denied it. Anyways if I quit I have for my understanding did my due diligence and have a just cause, since I won't be able to pay my bills or feed my kids on 20 hrs (unless I sell on ebay but that is no guarantee), so my next step is quiting, I'll do a second availability change and a second try on the hours, but it won't get anywhere. Might want to check out if they will or not. Try to get as much documentation as possible as to what and why? It sounds like they maybe trying to get you to quit and perhaps they will not challenge. kutuzov Posted September 5, 2013 Author Report Share Posted September 5, 2013 Well givin the fact they don't respond to any of my concern, it will be impossible to know what they will do if I need to quit. The availability change is done on the computer, and their denial is also there, so I'll print that out. The schedule is all there too, but my paycheck states the average hours too, I got the last paycheck for last year and the last one with 70 hours pay, next one will be 40 hours pay. If they challenge it, I think I got evidence that they cut my hours, and that I try to work something out, by changing my availability in order to get a second job that's also in paper, and on their system. willingtocope Posted September 5, 2013 Report Share Posted September 5, 2013 I assume you've seen: http://www.stateofflorida.com/articles/florida-unemployment.aspx The first paragraph under Eligibilty says if you quit...you don't qualify...but then the next line talks about 'partial unemployment". I'm guessing what this means is that if you continue to work 20 hrs / week, you may qualify for some money from the state. Don't quit until you find out... The state decides if you get benefits not the employer and if they are offering you 20 hours UI is most likely going to expect you to work SOMETHING if it is available. One of the key qualifiers for collecting benefits is that you not turn down viable work and quitting would be doing that so it would very likely kill any claim you had to the benefits. Another reason not to quit is it is WAY easier to find a job while still employed. There is still a stigma to being unemployed despite the recession. Your best option is to try and find another job as quickly as possible while still working this one. You more than likely qualify for partial UI due to the reduction in hours it just takes time to process the application. 1 Link to comment Share on other sites More sharing options...

And unless they are trying to get you to quit, they will not take kindly to that. (A good thing for you) So they have a couple of choices....give you all your hours, drop your status down to perm. part time, or lay you off. My personal feeling is they are doing this in anticipation of the new obamacare regulations that go into effect on Oct. 1st. Is anyone else getting their hours cut? kutuzov Posted September 6, 2013 Author Report Share Posted September 6, 2013 I don't think is cause obamacare I got health insurance with them already, and I only lose the insurance if I fall under 21 average hours in 1 year, so even at 20 I won't lose it until 2015 since the benefits are determined by your annual average hours and won't change for the year, even if you fall under the average once you got them. I like the lay me off, and have plenty of time to look for another job while being paid. I didn't tell them, I already got with them and no one spoke with me, so even if I wanted I couldn't do it. Most likely once the partial UE starts they will give me back my hours just so not to pay for not working and on top of that not getting the job done. kutuzov Posted September 17, 2013 Author Report Share Posted September 17, 2013 All right. Partial Unemployment was approved, and guess what, they bump my hours to 33 ... I guess they prefer to pay me for working than to pay me for not working. Anyways, unemployment requires me to apply for 5 jobs a week, so I applied for a Charge-off specialist!!!!! Just for fun and see how it goes, is with a local Credit Union so not a nasty JDB, but anyways will see how it goes, not that I like the job but as it's a OC you can always move later to another Dpt. if I get hired. 1 Link to comment Share on other sites More sharing options...
