sillymonkey Posted September 9, 2013 Report Share Posted September 9, 2013 Hi,I'm going to add this claim in JAMS but I was wondering if anyone has case law to support this claim..If we are currently in arb for the alleged debt, does that still come under 'collection purpose' under the FCRA? ie can they pull the credit report while the case is still in arb?Thanks for all insights! willingtocope Posted September 9, 2013 Report Share Posted September 9, 2013 My guess is that the OC would claim that you have a "credit relationship" with them...thereby giving them "permissable purpose". (IMO, that's one of the pitfalls to choosing arbitration. You sort of have to admit you have a contract with them in order to invoke the terms of that contract).
