Midland talked to me over the phone after getting my C&D. Do I have anything?

I called them today just to see if I can work anything out since they sent me validation. I had the call recorded. The rep didnt say the usual "this is a debt blah blah" and he didnt ask me if its ok to talk to me since they have received a C&D from me. A few other collection agencies that I've C&Ded always ask me to state that its ok for them to talk to me if I call them but not this one. Do I have anything here?
