stanislavbr Posted September 11, 2013 Report Share Posted September 11, 2013 So I objected to a bunch of affidavits using ccp 2015.5 cause it didn't have "I certify (or declare) under penalty of perjury under the laws ofthe State of California that the foregoing is true and correct" quoted this case Kulshrestha v. First Union Commercial Corp. (2004)33 Cal.4th 601 Kinda worried that it won't work but after reading the case it defines an affidavit: Since 1872, an affidavit has been defined as "a written declaration under oath" (? 2003),taken before "any officer authorized to administer oaths." (? 2012; see ?? 2013-2014,2093 [officers]; 6 Witkin, Cal. Procedure (4th ed. 1997) Provisional Remedies, ? 2, p. 25.) Should I have anything to worry about? Any opinions?
