sloop Posted October 1, 2013 Report Share Posted October 1, 2013 Hello, I've read another thread on this topic but I'm hoping for a little more direction if that's possible. I received a summons from Calvary SPV I. At first I was unsure what it was, but after googleing them I cam to this forum and read about someone else with a similar situation. The amount they are suing for is $3,111.94. I don't remember the exact date I got served and they failed to write the date it happened on the service papers. I believe in the documents it says that the balance is owed from March 31, 2011, so I'm thinking that's probably the last time I made a payment but I'm unsure. I know what was recommended to the other user was that Calvary has to prove they own the debt and most of the time that can get me off the hook but I'm wondering about the timeline. My court date isn't even set until July 28th, 2014 which is over the 3 year statute of limitations for North Carolina where I think the Bank of America corporate office is located. Savoir Posted October 1, 2013 Report Share Posted October 1, 2013 You only have a certain amount of time to file an answer to the Summons and Complaint (I'm not from your state so I can't tell you how much time you have).You will need to read your Rules of Civil Procedure. Once suit has been filed, the SOL is tolled (stopped from running) so, unless the SOL has already run before suit was filed, I'd try another defense.
