perchdinner Posted October 13, 2013 Report Share Posted October 13, 2013 I filed for a summary judgment agaisnt a jdb and it was due on Friday the 11th . The rules state 14 days to respond. Harry Seaward Posted October 13, 2013 Report Share Posted October 13, 2013 Facts and evidence put forward at Summary Judgment are generally viewed 'in the light most favorable to the nonmoving party'. If you submitted some pretty solid evidence and the other side failed to counter that evidence, you will most likely prevail by default. Now, it's possible they unintentionally missed the deadline and will file a response at some point, and the judge will probably allow their response in the interest of preventing a 'miscarriage of justice'.
