Back Story: I recently, the last couple of years have been attempting to clean up my credit report, paid of most as I don't have all that many trade lines on my account. I more recently came across a article post which you can view here, that basically states that because every state has different SOL's which a collection agency can go after debt for, if that time has expired the CRA's are supposed to remove these items off of your report. BV80 Posted November 12, 2013 Report Share Posted November 12, 2013 @syulinoire A state's SOL for collection is the period of time in which you can be sued for a debt. It has nothing to do with the amount of time a negative account can remain on your credit report (CR). The Fair Credit Reporting Act (FCRA) provides that a negative account can remain on your CR for 7 to 7.5 years from the date of first delinquency (DOFD). In the case of an original creditor (OC), see what date they give as the DOFD. The account should be deleted approximately 7 years from that date. If a JDB has purchased the account from the OC and has placed an entry on your CR, the amount of time that entry can remain on your CR is based on the OC's DOFD. syulinoire Posted November 13, 2013 Author Report Share Posted November 13, 2013 Thanks for the info! I kinda had a suspicion it was too good to be true! LOL I have been making some phone calls in the meantime trying to get correct information about the actual time of service compared to when it was actually placed for collection. Which in my case was almost a year to the day? But I will call and find out exactly when it was place in collection. Surprising the JDB (junk debt buyer I assume) is attempting to collect on a medical debt that was already paid for by my insurance.... Which I believe was a issue due to the fact I had recently changed insurances and they were both active at the same time? But either way the service has been paid for. I did get both insurance companies to send me my coverage information during that time to cover my bases when I go to correct this error. One thing that made me curious was when the I spoke to the CA (collection agency?) the agent wanted to know when the service had been paid? I asked why and she stated that if it was after they bought the account, the only thing they could do would be to place it under "paid in full" which I can't understand because it was paid the same month that the service was rendered? Is there anything I can do about this? P.S. I'm really glad you responded I was reading your comments on FCRA violations and lawsuits, was very inspired to jump down the rabbit hole!
