The MA act referenced in the above link provides for attorneys' fees. You may want to consult with that atty I mentioned in an earlier post or someone from www.naca.net to see if you have a valid claim.

If the OP did not request validation before the lawsuit commenced, he may not have a claim. Under the FDCPA, a complaint is not an initial communication that triggers the validation requirement. It may be the same for the MA statute unless it provides otherwise.

It would depend upon when the OP requested validation.

It's unclear to me when exactly DV was requested. I just now found about the MA requirement, although I haven't read the exact wording of the statute. It seems that under the right circumstances, it would make a good counterclaim.

I agree that it makes a good counterclaim under the right circumstances. Perhaps the OP did make a timely DV request before the lawsuit was ever filed. He hasn't provided that detail.
