xlxaxa
I have a few random questions that I'm not sure whether are violations ot not of the Fair Credit Reporting Act. - Do collection agencies have to notify me in writing befoe they report to the credit bureaus for the first time?- Whenever I didpute something, aren't they supposed to mark that entry on my credit report as being disputed? If they don't do it... is this a violation?- If they show a different amount than origina creditor, is this allowed? If so... what's the interest that they can chatge?- I have a coule accounts where the collection agency name theirselves as the original creditor as well? Violation?- Can collection agency report past due amounts?- They are reporting my accounts using my first and partial last name only? Could this be treated as an error?- Can the report to credit agencies during validation?- Any other normal violations? Thanks everybody! Yes, but that can take up to a month or more to update. 3. Yes, the amount of interest depends on your contract with the creditor and your state's laws.4. No. They are listing themselves as the reporter/agent for the creditor. Trade lines report like this all the time.5. Yes they can report past due amounts. 6. If they were already reporting when you requested the validation: YES. They are not required to stop reporting simply because you asked for validation. Whether there are any other violations depends on the specifics of your situation and is impossible to answer based on a vague question. Goody_Ouchless
#3 is where violations live. If they are reporting one number, yet trying to collect another. For example, reporting interest that they know they are not entitled to. To pursue this you must dispute to the Credit Reporting Agencies and have them reach out to the Creditor. BV80
@xlxaxa Note that in order to sue under the Fair Credit Reporting Act, you must dispute the account entry with the credit reporting agencies. If you only dispute directly with the creditor or JDB, you do not have a private right of action under that Act.
