arncowife Posted September 14, 2015 Report Posted September 14, 2015 I have had my head in the sand for years and have finally pulled my CR. I have been reading through the forums all day and have some questions. 1. Can old addresses be removed from the reports? I'm not just talking 1 previous address--there are 4!2. What about the AKA. This AKA is my previous married name from 20 years ago! 3. I have 1 account that is listed as transferred or sold/charged off. It appears that the last payment was in February 2011. Portfolio purchased it 6/2012. My question is regarding SOL. I live in FL. The original debt is also in FL. PRA is in VA. Does the SOL change when the debt is purchased by PRA? Because, I honestly do not remember getting anything in the mail about validating this debt. That time was a blur for me. Hubby had started treatment at the VA just prior to that, so my priorities were a little different. 4. I have another one that is similar, but the CA that purchased is Midland Funding located in CA. Do I do a 623 dispute methods starting with CRAs? Or, am I off in left field? Any and all help is appreciated. Thanks! Quote

Old addresses cannot be removed if they are tied to trade lines that are reporting. 3. I have 1 account that is listed as transferred or sold/charged off. No, the SOL does not change because the debt is sold. Sit tight for a week or two. Both of these junk debt buyers just settled with the CFPB and your account(s) may be ones that are no longer collectible as part of the settlement. You may be able to leverage deletion based on that. fisthardcheese Posted September 14, 2015 Report Posted September 14, 2015 Your SOL will always only be based on Florida law, since that is where you reside. I would not do anything with these accounts until after Feb when they will be SOL. Unless one of them sends a collection letter, in which case I would respond with a very simple "I dispute this alleged debt" and nothing more. After these are past the SOL, I would just dispute them with the CRAs and work from there. You have several possibly ways to remove the JDBs from your credit reports after SOL and there are potential violations of federal consumer law. I would suggest reading up on Florida's consumer laws too. They have a state statute similar to the FDCPA but it has some other requirements that the collectors must abide by. I would make sure they are following all those laws to the letter. If they aren't, that will be your leverage to make them go away. Quote
