Midland refuses to arbitrate, so once the court has ordered arb, their only other choice is to dismiss the case.

What is a MTC? How do you do this?

I suggest starting your own thread, since this one is so old. 

MTC stands for Motion to Compel. You'll have to look into how to do this in your state/specific court because each has its own procedures. There's a wealth of information on this site, but you'll have to research.
