Memorandum of Costs After Judgement

Help! Over the weekend I received a Memorandum of Costs After Judgement from Hunt and Henriques Attorney at Law.  The plantiff is Citibank the amount is 1,333.99. I honestly do not know where this came from?  I checked my credit report and there is no record of even an old account with Citibank.  Where do I go from here?

It sounds like Citibank sued you, obtained a judgment against you and is now filing for costs. If that's the case, there should be a case# on the memorandum, can you look that up in your court's online system to see what has happened?

A default judgment is obtained if a defendant doesn't respond to a summons and complaint.  It could be that you were not properly served, or someone accepted service for you but didn't inform you of a summons.  It could also be a case of mistaken identity.

Call the court and speak to a clerk to have him look up a lawsuit in your name and the case number.   If there's nothing in your name or the case number is not in your name, contact the attorney.

if you are in Orange county and cannot find the case number for any reason. go to https://apps.occourts.org/  you may have to create an account to run a name search. the first search may be free if I  remember correctly, all other searches are $1 each.

if the court is close to you you can walk in and ask for a copy of the complaint and the proof of service.

What you want is a copy of the complaint and the "return on summons" or the proof of service of the summons and complaint.  That document will tell you what plaintiff told the court about how you were served in the action.

 

You might also look at the docket to verify what your friend told you about when the judgment was entered.  It is hard to see how a memo of costs is timely now for a judgment that was entered in 1999.
