jameswillson300
I had a default judgement. However, I was able to settle it for less amount and paid it off on 10/8/16. It's been a month, and they haven't filed the satisfaction of judgement to the court yet. I've called them several times, emailed them several times, and they only said it will take sometime. I was recently denied of a city job because of this. Anything I can do to speed up the process? Any help would be appreciated! It's hurting my chance of new employment. Harry Seaward
In the settlement, how much time did you allow them to release the judgment? If there was no such agreement, I would file a motion for injunctive relief to ask the court to order them to file the satisfaction of judgment, notify the respective credit bureaus and provide you with proof of same within 10 days of said order. The reality is they will be allowed a certain amount of time to respond to your motion (usu. 10 days) then you will be given time to reply to their response (usu. 5 days) and then, if there is a dispute, the court may set it for a hearing which could take a month, so it probably won't happen any sooner than if you were to just wait it out. But if you want to take matters into your own hands, that's about the only option you have, unless they are violating an agreement.
jameswillson300
There was no such agreement. I agreed for the amount, but there wan't any time frame explaining when they would release judgment. I thought plaintiff had 30 or 60 days to release judgment by the law. Is filing a motion for injunctive relief my only option? If I wait it out, would they release judgment in timely manner?

You NEVER agree to a settlement where all the terms are not in writing. 1 hour ago, jameswillson300 said: I thought plaintiff had 30 or 60 days to release judgment by the law. You would have to quote the statute in Iowa law that requires this. 1 hour ago, jameswillson300 said: If I wait it out, would they release judgment in timely manner? We have no way of knowing what they will do.

According to IA statute, 624.37, you have to send a request in writing to the judgment creditor and include a draft release of the judgement. It doesn't explain "draft release". You'd need to ask an attorney. Here's a court form that also address the draft release. http://www.iowacourts.gov/wfdata/files/EDMS/eFormsOctober2012/eForm3.22AppReleaseandSatisfaction102412.pdf
