Cause of Action

Recommended Posts

I am writing my Demand for Bill of Particulars and I am wondering what to put here:  "...setting forth the items and details of the account on which the cause of action for ________________________________ of plaintiff's complaint is based..."

In the Complaint, the first cause of action was a credit loan and the second cause of action was book account for goods sold and delivered or services rendered.

Thanks in advance.

Let's hereby change our BOP to read as follows:

"...setting forth the items and details of the account on which  plaintiff's complaint is based..."

No need to flag any cause of action that permits a BOP.  Just makes it easier for them to object.

Can I be more specific or is it best to keep it a general request?  There are specific things I would like which I could request through discovery, but I like the fact that a BOP is conclusive.  Please advise.
