Being Sued by Cavalry SPV; Please Help with answer

Being used by Cavalry of a really vague complaint with no evidence sent to me. Can someone please help me.

 

Plaintiff, CAVALRY SPV I, LLC, AS ASSIGNEE OF CITIBANK, N.A., by way of Complaint against defendants says:

 

1. Plaintiff sues for the price of goods sold and/or services rendered on a book account

2. The account number ends in 3895

3. There is still due on said account the sun of $8,112.63 of which no part has been paid although repeated demands for same have been made and as often refused

4. The original creditor is Citibank N.A.

5. The account was sold by the original creditor to Plaintiff?

    How are they an assignee if it was sold

6. The current owner of the account is CAVALRY SPV I, LLC, AS ASSIGNEE OF CITIBANK, N.A. 

7. The defendant social security number ends in 508

 

How is someone saying they are an assignee on behalf of Citibank also saying they are the owners? Isn't that a conflict of terms

No.  Assigned, sold, transferred, successor.  All the same thing.

You seem to be in "beat them with a technicality" mode.  Get out that mode because they will show up to court with everything they need to win.

Instead, I would be considering using arbitration to make this debt cost them way more than it's worth for them, subsequently causing them to dismiss their claims.  NJ small claims is capped at $5,000, so the small claims carve out from the Citi agreement doesn't apply to your case.

How should I respond to the complaint seeing if I don’t they win automatically. Also quick question I can’t find any information about Citibank on any of my credit reports. How would I get the charge off date to see if it is even still in SOL if it is mine
