Evasive process server...

Recommended Posts

Hello!  5 days ago, on a Thursday evening, a man apparently holding court documents came to my home. He rang the doorbell (around 730pm) and my daughter asked who it was. He said he was looking for me to drop off documents. She ran to the kitchen (she is 16) to my BF telling him about the guy at the door. I was grocery shopping for a friend who just had surgery.

My BF asked for a card so I could call him, he refused giving a card or info where I could call him, so BF told him I’m home all day every day and advised to return the next day.

Aware of this servicing, I’ve not left my house in 5 days anticipating this guys return,  he hasn’t. I’m nervous after reading forums about people evading service, and how it can just get worse. This has never happened to me and I want to be compliant and fix whatever the papers contain. Not sure what to do, tried the county website and no help.

It crossed my mind if someone may have been casing my home, and since I have a young daughter, I’m freaked out at that thought!

help?  I appreciate iate any info so I can get this handled!

First thing you can do is check the county courthouse website and see if you have been sued. If you have, you can find out who the plaintiff attorneys are and can call them and set up an appointment to be served. If you are not being sued, they you should report the incident to the police ASAP.

This.

A legitimate process server will almost always give out information where he can be reached, to facilitate service.

Something fishy may be going on.

I see three main possibilities of something fishy:

1. The guy is not a real process server.  If you haven't been sued, call the cops ASAP.

2. He is real, but is playing some weird game where he will claim to have gone to serve you several times, but not return, and make they do a publication service.  (I had a publication service when I was on vacation for a week.  They didn't care I was back, they had stopped by twice and that was it.  It just caused problems for the law firm, but the server didn't care).

3. He is real, and you will wind up with the infamous "sewer service".

Thank you for your post, I’ve lived in 3 counties, 2 I couldn’t find anything. I’m not really sure I looked in the correct places on each website. I found my divorce stuff in one, I have one here for something that’s being settled by AAA, but can’t find anything else. Can we actually find something if we havent been served?

this is driving me close to crazy, lol. I can’t sit home all day every day, and don’t want to be in trouble for it!

Usually, yes, but it's possible you were not sued in the correct 'jurisdiction'. If there is a way to do a statewide search, you should do that.

Hi there- I tried that, for about 3 hours and what a nightmare. CA takes me everywhere but what I’m looking for, ugh!

thank you for your post!
