California Midland Funding and REQUESTS FOR ADMISSIONS

I need a little help with how to answer the request for admissions sent to me from Midland Funding.  First off, they are listed as Midland Funding LLC, as assignee of Sherman Originator III LLC, as assignee of MHC RECEIVABLES LLC, as assignee of Credit One Bank.   How do I respond to these when they have sent 22 pages of billing statements and a copy of Cardholder agreement.

 

1. Admit to the genuineess of the documents attached as EXIBIT 1, monthly billing statements  for Credit One Bank, with Account number

 

2. Admit to the genuiness if the documents attached hereto as EXIBIT 2, VISA/MASTERCARD CARDHOLDER AGREEMENT for Credit One Bank with account number

ALL of those entities are owned by the parent company the Sherman Group.  Those "transfers" are nothing more than moving the losses around for a tax write off.  It has zero affect on this suit as in reality they are all the same company.

DENIED. Defendant is not employed by The Sherman Originator III LLC, Midland Funding LLC, MHC Receivables LLC or Credit One Bank and therefore not qualified to certify the genuiness of any document alleged to be produced or maintained by one of those entities.

DENIED.  Defendant is not employed by VISA, MASTERCARD or Credit One Bank and cannot attest to the authenticity of the document attached.  Additionally the Plaintiff has provided no source for said document by which its authenticity and genuiness can be evaluated.

you can also simply denied  them both. DENIED.

you dont have to argue the fact that you have never worked for any of those entities.
