THELEGEND Posted August 26, 2018 Report Share Posted August 26, 2018 Guys been going back and forth with rausch,who represents crown,with synchrony account. The account is only 2 years old and i requested validation. They sent same ole stuff.. copies of statements but nothing that shows they purchased the account. Sit still and wait? With a Synchrony account I would notify RSIEH that I want to settle this dispute in JAMS arbitration. Synchrony has one of the best arbitration clauses of all creditors. If you say you want to use arbitration now, but do nothing more to get the case into arb, RSIEH could possibly come back after they sue and ask the court to deny your Motion to Compel arbitration on the grounds that you didn't "follow the rules" of arbitration. While I happen to believe this is not a proper reason for a court to deny a MTC, it happened quite recently, and now the consumer is in a position where they are facing an appeal because of it. And for the record, I would use AAA instead of JAMS. AAA consumer fees are a little less than JAMS, but more importantly, AAA rules specifically prohibit the arbitrator from reallocating the JDBs fees back to you at the conclusion of arbitration. JAMS rules are not quite as clear on this matter. It's unlikely a JDB would ever follow a consumer into arbitration, but this one fact makes it that much less likely with AAA as the arbitrator. Or you settle. i already mentioned arb in the validation i sent them but also stated i would pursue arb. if they continue collection.
